Notice of Privacy Practices

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Who this notice covers

This notice applies to Stillwater Osteopathic Medicine, the practice of Jared Dubey, DO, and to the health information the practice creates and keeps about you.

Our duties

We are required by law to maintain the privacy and security of your health information, to give you this notice of our legal duties and privacy practices, to follow the terms of the notice currently in effect, and to notify you promptly if a breach ever compromises your information.

How we may use and share your health information

Treatment. We use your health information to provide your care — reviewing your history before a visit, or, with your knowledge, coordinating with another clinician involved in your care, such as your primary care physician.

Payment. Stillwater is a direct-pay practice and does not bill insurance. We use your information to take payment at the time of service and, at your request, to prepare a superbill — an itemized receipt — for you to submit to your insurer. We do not send your information to your insurance company; if you submit a superbill, you are choosing to share it.

Running the practice. The everyday work of a small practice: scheduling, record-keeping, and quality improvement. We use secure electronic systems for charts and appointments that are contractually required to safeguard your information.

Appointment reminders. We may call, text, or email to confirm or follow up on an appointment. Tell us if you’d rather be reached a particular way, or not at all.

People involved in your care. If you bring someone into the treatment room or ask us to keep a family member updated, we take that as your permission to speak with them about your care. Parents and guardians generally have access to a minor child’s information, with limited exceptions under Wisconsin law.

When required or permitted by law. Some disclosures are required or specifically allowed by law, including:

• public health reporting, such as communicable disease reports
• reporting suspected abuse or neglect
• health oversight activities, such as audits and licensure reviews
• court orders, subpoenas, and other lawful process
• limited law-enforcement circumstances
• preventing a serious and imminent threat to anyone’s health or safety
• workers’ compensation claims
• coroners and medical examiners

Uses that require your written authorization

Anything not described in this notice happens only with your written authorization. That includes marketing, any sale of your information (which we do not do), and sharing your story publicly — a testimonial appears on this site only with the patient’s written permission, and even then with the name shortened. You can revoke an authorization in writing at any time; the revocation applies going forward.

Your rights

• See and get a copy of your record. Ask in writing; we will provide it within the time the law allows and may charge a reasonable, cost-based fee for copies.
• Ask us to correct it. If you believe something is wrong or missing, you can request an amendment in writing. If we decline, we will explain why and note your disagreement in the record.
• Know with whom it has been shared. You can request an accounting of certain disclosures made in the prior six years.
• Ask us to limit what we share. You can request restrictions on how we use or share your information. Because we do not bill insurance, nothing about your care goes to your health plan unless you send it or direct us to.
• Choose how we reach you. You can ask us to contact you only in a certain way or at a certain place — a particular phone number, for example. We will accommodate reasonable requests.
• Get a paper copy of this notice at any visit, even if you have read it here.
• Be notified of a breach that compromises your information.

Wisconsin law

Wisconsin’s patient health care records law (Wis. Stat. § 146.81–146.84) adds protections of its own. Where state law is stricter than federal law, we follow the stricter rule.

Concerns and complaints

If you believe your privacy rights have been violated, or you have any concern about how your information is handled, contact Dr. Dubey directly at (608) 301-5641 or jared@stillwaterdo.com. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights: 200 Independence Avenue SW, Washington, DC 20201; 1-800-368-1019; hhs.gov/ocr. We will never retaliate against you for raising a concern or filing a complaint.

Changes to this notice

We may update this notice as the practice or the law changes. The current version is always posted on this page and available on paper at the office, and its terms apply to all health information we hold.
